MARCH EXPO PROMOTION OFFICIAL RULES
The following terms and conditions are the official rules (“Official Rules”) that shall apply to the Alibaba.com March Expo promotional campaign being run on the business-to-business www.alibaba.com platform.
1. Promotion: During the Promotion Period (in section 3 below), Eligible Members (set out in section 5 below) who satisfy the requirements under section 6 for the respective promotion shall be entitled to enjoy the applicable promotion.
2. Organiser: Alibaba.com Singapore E-Services Private Limited, a company incorporated in Singapore with registered office address at 10 Collyer Quay, #10-01, Ocean Financial Centre, Singapore 049315 (“Organiser”).
3. Promotion Period: 5 March 2018 (00:00:00 PST) to 31 March 2018 (23:59:59 PDT).
4. Availabillity: The Website, and/or Alibaba.com iPhone and Android App, Android Pads, iPads, subject to the Promotion-specific rules
5. Eligible Member: You shall be a registered Alibaba.com user and have agreed to all the applicable terms and conditions applicable to you, including the Alibaba.com Terms of Use and Privacy Policy. Employees, officers and directors of the Organiser and their respective immediate family members, affiliated and subsidiary companies, any company involved in the Promotion, together with their agents are not eligible to enter. In addition, the following Promotion-specific rules and eligibility requirements shall apply in respect of the following Promotions.
Promotion-specific rules
During the Promotion Period, each Eligible Member entering into a Trade Assurance order of more than US$3000 with an initial payment of above US$1000 may enjoy on that order a one-time free inspection service worth up to US$150 (“Free Inspection Service”) in respect of the relevant Trade Assurance order provided by the relevant inspection company that is participating in the Promotion, and the following additional terms and conditions governing the Free Inspection Service shall apply:
1. You shall agree to the Terms and Conditions of use of Independent Third Party Inspection Services and the terms and conditions of the relevant inspection service agreement applicable to you;
2. The Free Inspection Service is only available prior to shipment of the relevant goods and will only be conducted in Mainland China (excluding Chongqing, Guizhou, Hainan, Heilongjiang, Jilin, Ningxia, Inner Mongolia, Qinghai, Tibet, the Gansu, Sichuan and Xinjiang Provinces as well as such other regions which the Organiser may from time to time determine and announce on Alibaba.com);
3. Your supplier of goods is a Gold Supplier based in China and is using Shenzhen One-Touch Supply Chain Service Co., Ltd and/or its relevant affiliate or related company as a service provider for customs declaration and customs clearance of the goods;
4. Your chosen inspection service provider shall inspect the ordered goods under the Trade Assurance order no later than 31 July 2018. Failure or rejection by a Eligible Member to contract with the relevant Inspection company and/or arrange the inspection within the specified time will be deemed as the Eligible Member’s forfeiture of the Free Inspection Service. Unused Free Inspection Service will lapse and cannot be refunded or exchanged for any other service;
5. Initial payments for the trade assurance order made via T/T (telegraphic transfer) must be booked by the supplier on account in the Alibaba.com system, and initial payments made via e-checking must be received by the designated beneficiary bank by the end of the Promotion Period. For the avoidance of doubt, any payment received outside of the Promotion Period will not enjoy the Free Inspection Service;
6. If you have made a Trade Assurance order fulfilling the aforementioned requirements before the Promotion Period, to the extent that you are able to amend your Trade Assurance order to fall within the requirements, you may be entitled to enjoy the Free Inspection Services;
In the event an applicable Trade Assurance order is cancelled, closed or terminated for any reason or a dispute arises between the Eligible Member and the supplier that is not resolved within the Promotion Period, the Free Inspection Service will automatically become void; and
THE FREE INSPECTION SERVICES ARE PROVIDED DIRECTLY BY THE RELEVANT INSPECTION COMPANY AND NOT BY ALIBABA.COM. ELIGIBLE MEMBERS ARE REQUIRED TO ENTER INTO INDEPENDENT CONTRACTS WITH THE INSPECTION COMPANY IN RESPECT OF THE PERFORMANCE OF THE FREE INSPECTION SERVICES. ALIBABA.COM SHALL NOT BE LIABLE TO ELIGIBLE MEMBER AND/OR ANY THIRD PARTIES FOR ANY INJURIES, HARMS, LOSSES AND/OR DAMAGES CAUSED TO ELIGIBLE MEMBER AND/OR ANY THIRD PARTIES ARISING FROM THESE PARTIES’ USE OF THE FREE INSPECTION SERVICES.
The Organiser and each of its related companies or affiliates makes no warranties or representations of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for purpose, and completeness of the inspection services provided by the third party inspection service company. Use of the Free Inspection Service is at your own risk
During the Promotion Period, an Eligible Member that is also a buyer residing or having a place of business in the United States in respect of the relevant Trade Assurance order is also eligible to enjoy the Promotional TT Service, which shall consist of the following:

1. You shall place a trade assurance order on Alibaba.com during the Promotion Period;
2. You have selected telegraphic transfer (TT) as your mode of payment utilizing a United States bank account and are making payment to the following US based Citi account:

During the Promotion Period, Eligible Members making the initial payment for Trade Assurance orders during the Promotion Period may enjoy 15% off LCL Shipping Service to the U.S. (“LCL Shipping”) charges for port-to-door and door-to-door if such Eligible Members are residing or having a place of business in the United States and have selected “LCL Service” provided on the product detail page on www.alibaba.com or http://shipping.alibaba.com, and the following additional terms and conditions governing the LCL Shipping Service shall apply:
The “Organiser” for the purposes of the LCL Shipping Service shall be Shenzhen One Touch Supply Chain Service Co., Ltd, a member of the Alibaba Group, and not Alibaba.com Singapore E-services Private Limited; and the LCL Shipping Promotion excludes additional service charges and other special operating charges (including but not limited to customer order revision charges, unloading of delivery at door, inspection charges, warehousing overdue fees, tariffs, customs clearance duties, and insurance charges).
In view of the nature and scope of the relevant Promotions, the Organiser reserves the right, in addition to those other rights reserved herein, to modify any date(s), deadline(s), terms and conditions set forth in these Official Rules or otherwise governing the relevant Promotion.
In the event that the Promotion is ceased or suspended by the relevant authorities, due to serious network attack or system fault, or due to any reason out of the reasonable control of the Organiser, the Promotion may be terminated prematurely. Such situation will be classified as a force majeure event and the Organiser shall not be liable for any damages or claims that arise out of the event.
The Organiser reserves the right to disqualify you from participating in the Promotion at any time in its sole discretion, including without limitation, due to any breach by you of these Official Rules, or if any complaint is made against you for any misconduct or breach of Website rules and/or applicable laws.
You acknowledge and agree that the Organiser or any of its affiliates or related companies in the Alibaba Group shall not be responsible, and shall have no liability to you or anyone else for any dispute or claim that arises out of your participation in this Promotion.
By participating in this Promotion, you agree to be bound by these Official Rules. The Organiser reserves the right in its sole and absolute discretion to cancel, modify or suspend the Official Rules or this Promotion in whole or in part, without liability to you. The amended and restated Official Rules shall be effective immediately upon posting on the relevant Platform. After posting of the amended and restated Official Rules, your continued participation in this Promotion shall be deemed to be your acceptance of the amended and restated Official Rules.
The Organizer is not responsible for any late, lost, delayed, incomplete, illegible, misdirected or undeliverable entries, responses, or other correspondence, whether by e-mail or otherwise. Time and validity of any transactions and/or your eligibility to the Promotions shall be determined by the Organiser at it sole discretion based on the Organiser’s record. If there is any discrepancy between the record of transaction held by you and that held by the Organiser, the Organiser’s record shall be conclusive and binding on you
Limitation of liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW, In no event will the ORGANISER be liable to any participant for any direct, INDIRECT, special, incidental, exemplary, punitive or consequential damages (including loss of use, data, business or profits) arising out of or in connection with the participant’s participation in the Promotion, whether such liability arises from any claim based upon contract, warranty, tort (including negligence), strict liability or otherwise, and whether or not organiser HAs been advised of the possibility of such loss or damage.
Governing Law: You agree that the Promotion is governed, interpreted and enforced by the laws of the Hong Kong Special Administrative Region (“Hong Kong”), without regard to its conflict of laws principles. You and hereby agree to submit to the exclusive jurisdiction of the courts of Hong Kong for any disputes that arise out of your participation in the Promotion.
